These conditions are applicable, as soon as they are published on the website www.mmv.fr, to all services developed and sold by MMV.
Our brochure and our website www.mmv.fr complete the preliminary description given to the traveller pursuant to article R. 211-4 of the Tourism Code.
According to articles L211-9 and R211-5 of the French Tourism Code, MMV reserves the right, with the traveller's agreement, to modify some of the services offered and indicated in the description given to the traveller, in particular: the characteristics of the trip, the price, the payment terms, the minimum number of people required for the trip and the contractual cancellation costs. The reservation of a stay and/or a trip implies the acceptance of these special conditions of sale.
No right of withdrawal
Pursuant to Article L221-28-12° of the Consumer Code, the right of withdrawal does not apply to the provision of accommodation, transport, catering and leisure services which must be provided on a specific date or at a specific frequency.

The description of the stay programmes and the price tables contain the indicative of the services included in the proposed fixed prices. Our prices are published in Euros including VAT.
Prices do not include personal expenses.
These prices vary according to the period of the stay and sometimes according to the number of participants mentioned in the description of the stay.
1.1. The price tables
Located on the price pages, they contain an indication of the services included in the prices offered. Prices have been established in euros, as at 01/03/2018, according to hotel rates and economic conditions in France and are applicable to stays in Residence including all taxes (excluding tourist taxes) and including the provision of accommodation, including charges (water, electricity, heating).
Booked stays with a special non-refundable non-refundable rate will not give rise to any refund or modification and are fully due upon confirmation of the reservation.
1.2. Good tips
Coupon offers are subject to conditions, cannot be combined, are not retroactive, are limited by availability and are valid for the destinations and periods indicated. To access some of the special offers mentioned in the brochure and on the website, it is mandatory to indicate when booking the PROMO code of the chosen offer (e. g. SOLO for the "single supplement offered" offer). However, only the promotional codes provided at the time of booking will be taken into account.
1.3. The benefits retained
The services retained at the time of booking are due in full. Any service not consumed is not refundable.
RESIDENCE TAXES collected on behalf of municipalities are not included in our rates. They are to be paid on site in addition.
1.4. Security or security deposit
For rental stays: a deposit of 300 to 500 euros depending on the type of accommodation and furniture made available will be required upon arrival. It will be returned to you after your stay, after deduction of any replacement or cleaning costs and/or any other additional services not paid for. Any lost keys will be charged to the customer. The client is responsible for any broken or damaged object and for any damage that may be caused to the installations and fittings of the residence. If this guarantee proves to be insufficient, he would therefore be asked to perfect it.
For stays in Hotel Club, a deposit of 100 euros will be required for the use of certain equipment made available (padlock, hair dryer...). This deposit may also be used in the event of non-payment of services on site, in particular for bar consumption.
1.5. Children's rates in Hotel Club
Children's rates and free of charge apply only to children sharing a room with 2 people paying the adult rate, up to a maximum of 2 children per room. The rate for children applies according to the age of the child on the date of arrival of the stay.
If you have a child whose stay has not been invoiced to you ("Free accommodation"), the additional services consumed will have to be paid for on site, in addition.
In the case of a "single parent" registration, the child having to pay the adult rate benefits from a special discount of -25 to -15% on the basis of the adult full board rate.
II. PRICE REVISION:
The prices in the price tables were established on 01/03/2018 based on the prices of the various services in effect on that same date.
In the event of a variation resulting from the cost of fuel, the level of taxes or charges on travel services included in the contract or the exchange rates in relation to the contract, MMV will have the possibility to modify the selling prices upwards or downwards in accordance with Article R211-8 of the Tourism Code. In the event of an increase, whatever the amount, a clear and understandable supporting statement will be given to the client on a durable medium at the latest twenty (20) days before the beginning of the stay.
Any change in these economic conditions is therefore likely to result in a price change, in accordance with Article L 211-12 of the French Tourism Code. In the event of an increase in the fixed price of more than 8%, the customer may accept a modification of his contract and a substitute service or terminate his contract and obtain without penalty the reimbursement of the sums paid within a maximum period of 14 days, pursuant to the provisions of Article R 211-9 of the Tourism Code. The customer will have a period of 7 days to inform MMV in writing of his decision, beyond which his decision to terminate the contract will be subject to the fees provided for in Article X below. Conversely, in the event of a reduction in the above-mentioned costs, the customer may benefit from a proportional reduction in the price.
III. APPLICATION FEES
The booking fees are mandatory and must be paid in full when confirming the booking. For stays booked by phone from 5 nights: 25 € / package and from 15 € up to 4 nights included (A package cannot exceed 15 adults).
For bookings made on the website www.mmv.fr : 15 € / file for stays from 5 nights and 10 € / file up to 4 nights included. (A file cannot exceed 15 adults).
The booking fees will be increased by 10 € if the deposits have been paid by credit card on the site but the price of the stay is paid by any other means of payment than credit card.
IV. PAYMENT TERMS AND CONDITIONS
30% of the amount of the service will be paid as a deposit at the time of booking on the Accommodation section for residences and full board within the Club Hotels. For the so-called complementary services (ski lifts, ski equipment, well-being), 10% of the amount of the services will be paid as a deposit at the time of booking. The balance of the invoice must be paid at the latest one month before the beginning of the stay.
Registrations confirmed less than 30 days before the start of the stay must be accompanied by payment of the total amount of the reservation. In the case of a non-refundable, non-refundable fare, the total price of the stay is due as soon as the reservation is confirmed.
mmv will note the cancellation due to the client who has not paid the full amount of the stay at the end of the fixed periods and reserves the right to dispose, without prior notice, of the services cancelled by the client.
- According to Article 16 of Law No. 96-603 of 5/07/1996 amended on 4/03/2010, the term "massage" refers to all modelling manoeuvres carried out for exclusively aesthetic and comfort purposes, to the exclusion of any medical and therapeutic purpose, by qualified wellness masseurs or beauticians.
Payment for services is made at the time of booking.
Any cancellation of an appointment without justification by medical certificate or any change in schedule, not made 24 hours in advance or any appointment not honoured will not give rise to the replacement or refund of the reserved service which will then be invoiced in full.
V. ANCV / HOLIDAY VOUCHERS
MMV stays are approved to accept holiday vouchers. The sending of ANCV holiday cheques must be made BY RECOMMENDED MAIL with ACCEPTANCE OF RECEIPTION to MMV, 51 avenue France d'Outremer B.P.39 - 06701 SAINT LAURENT DU VAR CEDEX. MMV declines all responsibility in the event of sending ANCV holiday vouchers in normal mail.
VI. CONTRACT ASSIGNMENT
The customer may assign the contract concluded with MMV to any person who satisfies all the conditions applicable to the contract. To this end, he will inform MMV of his intention to transfer his contract on any durable medium within the meaning of Article L. 221-1 3° of the Consumer Code and making it possible to obtain an acknowledgement of receipt, at the latest seven (7) days before the beginning of the stay. Any transfer occurring less than seven (7) days before the beginning of the stay will be unenforceable against MMV. MMV will inform the transferor of any additional fees, royalties or other costs that may be incurred as a result of this transfer. The transferor and the transferee shall be jointly and severally liable for the payment of the balance of the price as well as any additional costs, fees or other charges caused by the transfer.
VII. RECEPTION CONDITIONS
OPENING DATES for the season are indicated on the price pages of the brochure.
1. In hotel clubs and MMV residences
For a stay in MMV Residence, a general description of the apartments is provided to the client. All photos contained in the commercial documents and in particular in the brochure or on the website are background and non-contractual photos. Similarly, all information concerning cultural or sporting activities transmitted to us by the Tourist Offices of the resorts cannot in any way engage MMV's responsibility.
MMV offers family holidays in the traditional sense, the accommodation is specially designed for this purpose.
It reserves the right to refuse any reservation made contrary to this principle, or which seeks to divert it.
The full names and ages of all participants, including newborns, must be provided at the time of booking. Any incorrect information may lead to the cancellation of the reservation without delay. For obvious reasons of safety (swimming pool, evacuation) or health (possible hospitalisation during the stay), minors who are not accompanied by one of their legal representatives within the meaning of Article 382 of the Civil Code are not admitted.
It may happen that certain activities and installations proposed and indicated in the description in the catalogue are deleted, in particular for climatic reasons or in case of force majeure, or do not work in the forward or backward season
Access to accommodation could be refused in the event of a disruptive attitude on the part of clients, contrary to the calm and serenity of the host site. MMV also reserves the right to cancel any reservation of a customer with whom there is a dispute regarding the payment of a previous order.
In the event of non-arrival on the scheduled arrival day and without written notice sent by the customer to the registered office within 5 days MMV reserves the right to offer the accommodation for sale.
Partner" benefits and promotions cannot be applied to a reservation already paid for in full or in part.
BEST PRICE WARRANTY - Warranty Conditions
If you have booked a stay in an MMV establishment, and if you find, within 7 days of your reservation and more than 30 days before the start of your stay, on the MMV website or on another website, a lower price for the same stay, on the same arrival and departure dates, with the same conditions and the same services, MMV undertakes via its "Best Price" guarantee to refund you the difference (refund if the balance is paid, or deduction from the final sum to be paid).
This guarantee applies to reservations made via the MMV reservation centre or the MMV website. The price of the stay booked (rental or full board, excluding ski services) with MMV is exclusive of administrative costs.
All our establishments are non-smoking.
2. In Hotel Club MMV - "Weekly" stays with full board
7 days / 7 nights: from the day of arrival for dinner (room allocation from 6pm) to the day of departure for breakfast (room release for 9am). When you make your reservation, you can obtain the keys to your room from 12 noon by booking (with an extra charge) the Early Check In. Without the purchase of this supplement, no check in before 6pm will be allowed on site.
ARRIVAL HOURS: Holidaymakers cannot access the establishments before 7:30 am in the morning in order to respect the rest of holidaymakers who are already residents.
ROOMS are not systematically composed of double beds. Rooms for 4 people are most often composed of a set of 2 bunk beds and 2 twin beds or a double bed.
SERVICES: It is recommended to refer to the description of the services of the desired establishment. For details of the services, please refer to the Practical Guide & Rates in the Winter 2018-2019 brochure. The choice of services must be specified at the time of booking, it is not possible to change it during the stay.
3. In Partner Residences and Club MMV Residences for rent
The keys are handed over from 5 p.m. on the day of arrival. The keys are returned before 10 am on the day of your departure. In the event of an impediment or late arrival, it is essential to inform the Residence in order to best organize your arrival outside the opening hours of the reception. When you make your reservation, you can obtain the keys to your apartment from 12 noon by booking (with an extra charge) the Early Check In. Without the purchase of this supplement, no check in before 5pm will be allowed on site.
STATE OF THE PLACE: The accommodation is fully equipped with crockery, cutlery, bedding, sheets and household linen. It is possible that we may not be able to carry out the verification - inventory of fixtures in your presence. In all cases, an inventory will be given to you upon your arrival. When you take possession of the property, it is essential that you check its accuracy and the proper functioning of household and sanitary appliances. It is your responsibility to report any shortcomings or anomalies to the person in charge on site within 24 hours of arrival.
On the day of departure, the accommodation must be returned in a clean condition, the inventory and inventory of fixtures checked. We would like to point out that if the accommodation is not returned in a decent state of cleanliness and/or the kitchen area has not been stored and/or cleaned, we will be obliged to charge you a fixed price for cleaning the kitchen area from 40€.
We remind you that the description specifies the maximum number of beds per type, and that the accommodation chosen, for security reasons, may under no circumstances be occupied by a number of people greater than that indicated in the reservation.
INTERIOR REGULATIONS: In order to facilitate the life of your holiday, internal regulations are posted at the reception desk. We thank you for reading it and respecting it.
4. Your special requests (allocation of accommodation)
You can submit a particular request when booking (view, floor, side by side accommodation...) This particular request concerning your accommodation can at no time be guaranteed by MMV. It only becomes contractual after acceptance by MMV.
Our team will do its best to satisfy you, however, your request will be considered subject to the feasibility and organization of the rooms or apartment and subject to the planning of the hotel or residence.
The impossibility of responding to your particular request will not result in any complaint to our services.
5. Wellness and spa equipment (reserved for +18 years old)
This service is offered according to the establishments. For a good hygiene and for your safety it is subject to specific regulations. Access to Wellness and Spa facilities is by reservation and subject to availability and within the limits of contraindications to the practice of these services. Any failure to comply with the internal regulations of the Wellness and Spa equipment may result in a ban on access to this equipment. Wearing a bathing suit and anti-slip sandals is mandatory, mobile phones, food and drinks other than those provided on the premises are prohibited.
The opening days and hours communicated in the commercial documents or confirmations of stay are given as an indication, the MMV team at your place of stay can decide or have the constraint to modify them at any time.
6. Ski lifts, ski equipment rental
For weekly stays, the lifts are sold in 6 days of packages for stays of 7 nights of accommodation. Indeed, the lift pass starts on Sunday morning and ends on Friday evening.
The same applies to the rental of ski equipment. You can pick up your equipment from Saturday 6pm and you must return it the following Friday at the end of the day. MMV cannot be held responsible in case of theft or breakage of the ski equipment. In order to avoid this type of inconvenience, we are at your disposal when booking insurance adapted to this type of incident. It should be noted that ski lift passes, ski equipment and ski lessons are reserved in their own name. It is therefore essential to provide precise information at the time of booking on the surnames, first names, dates of birth and the level of clients associated with these services. MMV cannot be held responsible for any failure or incorrect information on the part of the customer.
For stays up to 4 nights, the ski services start on the day of your arrival. For stays of 5 to 7 nights, the ski services start the day after arrival. When you book your ski services (through the central booking office or through our website), we invite you to check the start date of these services in the "RESERVED SERVICES" section of your confirmation and to contact us at least 7 days before the beginning of your stay for any changes.
Lost or unused ski passes and unused ski equipment will not be refunded by MMV.
In the event that the ski area is closed during the stay, MMV will reimburse its customers on the basis of the actual reimbursement granted to MMV by the company managing the ski lifts.
7. Children's club
In Hotel Club free access to the Teenagers Club or Club Teens is reserved for customers who have booked at least one full week's stay. Access to the Baby Club or Mini Club is limited to the number of places available in each Club Hotel upon priority booking.
In Résidence Club MMV Club Kids can be offered (depending on the period and the establishment), its access is free for 5 half-days from Monday to Friday and must be reserved when booking the apartment. Except in the case where they are expressly entrusted to our animators, the children are under the full responsibility of the parents. For their own safety, children with food allergies should be cared for by their parents at mealtimes and snacks.
In Club Hotels, pets are not allowed. In the MMV Club Residences, pets are accepted, at the rate of one pet per accommodation maximum, for a supplement per animal, per day or per week, payable at the time of your reservation or on site on your arrival (tattooed, vaccinated, presentation of the health booklet). They are allowed, kept on a leash, in the common areas but are not allowed near swimming pools. The owners are responsible for the good behaviour and cleanliness of their animals. We reserve the right to refuse and/or expel dangerous or aggressive animals or more generally disturbing the proper functioning of the residence.
VIII. CLAIMS CLAIMS
In order to avoid any inconvenience during the entire duration of the stay or trip and in accordance with Article L211-16 II of the Tourism Code, the customer must inform MMV as soon as possible of any non-conformity found during the performance of a travel service included in the package travel contract. Otherwise, the amount of the reduction or any damages due may be affected.
If a dispute cannot be settled on site, the claim must be sent to MMV 51 avenue France d'Outremer BP 39 06701 SAINT LAURENT DU VAR with all original supporting documents, BY RECOMMENDED MAIL as soon as the customer returns. To the extent that the signed sales contract is individual, any claim must be individual and not collective. The response time may vary depending on the duration of the provider survey. After having contacted the agency's customer service department and if there is no satisfactory response within 1 month, the customer may refer the matter to the Tourism and Travel Ombudsman, whose contact details are as follows: MTV Médiation Tourisme Voyage - BP 80 303 - 75 823 Paris Cedex 17. IX. CONDITIONS OF MODIFICATION
- 1. Before departure and in the event of external events or exceptional and unavoidable circumstances, MMV may have to cancel all or part of the planned services or postpone a stay. In this case, different alternatives in a station and equivalent equipment will be proposed. In the absence of an alternative solution, MMV will reimburse the corresponding sums paid, as well as all services requiring a prepayment (transport, etc.), excluding any additional compensation in accordance with Articles L211-13-3 and L 211-14 of the French Tourism Code.
- 3. in the event of a subsequent change (service, staff, etc.) in the initial booking, due to the customer, a processing fee of €10 per change will be charged, whether it is a booking made by telephone or on the Internet.
X. INSURANCE & CANCELLATION
In accordance with article L 211-14 I of the French Tourist Code, customers have the right to cancel their stay at any time, subject to the payment of cancellation fees as indicated in the scale below:

Reimbursement in the event of subscription to the Horizon Package: Reimbursement with the exception of the administrative costs, the HORIZON Package and the deductible of 45 euros per person from Allianz Travel.
Services at special rates such as those indicated as "non-refundable, non-refundable", due to their specific nature, justify a cancellation or modification fee of 100% of the total amount invoiced upon booking the file.
Cancellation fees will always be as mentioned in the above scale for all products in the catalogue as well as for additional services.
If the traveller provides proof of previous coverage for the risks covered by the insurance purchased, he/she has the option to terminate this insurance free of charge within fourteen (14) days as long as no coverage has been implemented.
XI. LIABILITY - RCP INSURANCE
In accordance with Article L 211-16 I of the Tourism Code, MMV is fully responsible for the performance of the services contained in the contract concluded and must provide assistance to the customer if he is in difficulty.
In accordance with Article L 211-16 II of the French Tourist Code, the customer must inform MMV as soon as possible of the non-compliance observed when performing a travel service included in the contract; the absence of notification may impact the determination of any price reduction or damages.
MMV will remedy the non-compliance, unless this is impossible or results in disproportionate costs in relation to the overall value of the travel services. In accordance with Article L 211-17 of the Tourism Code, the customer shall be entitled to an appropriate price reduction for any period of non-compliance of the services provided under the contract with MMV, unless it is established that such non-compliance is attributable to the customer, to a third party outside the provision of the travel services mentioned in the contract with MMV and that it is of an unforeseeable or unavoidable nature or results from exceptional and unavoidable circumstances.
Apartments and rooms are allocated by MMV according to availability. This allocation may be modified at any time before the actual handing over of the keys. MMV can therefore in no way guarantee a precise location for the chosen hosting. Only the place, dates and type of accommodation are guaranteed.
In any event, if compliance with an essential element of the contract is made impossible as a result of an external event that is binding on MMV, MMV will inform the customer of the situation as soon as possible. The customer may then accept an amendment to the contract proposed by MMV or cancel the contract free of charge.
MMV has taken out a "hotel" type civil liability contract. However, it is recommended that holidaymakers be personally insured for civil liability. In the event of loss, theft of personal belongings or damage caused to third parties in the accommodation establishments, MMV cannot be held liable beyond the legal provisions.
XII. PROVISIONS SPECIFIC TO CERTAIN STAYS
If you have booked a stay of 7 consecutive nights skiing in winter in an MMV establishment via the MMV reservation centre or the MMV website, you can benefit from the MMV Best Snow Guarantee. Between 14 and 7 days before your departure, if you notice on our website on the France-Mountains block of the page of your destination that 50% of the slopes of the ski area are closed for 4 consecutive days, we undertake to offer you another MMV destination (of the same category: hotel club or residence club). If we are unable to do so, we will make you a proposal in a different category of establishment (refund of the difference in MMV vouchers if the proposal is cheaper than your stay, MMV will cover the difference in price, within the limits of the services, if the proposal is more expensive). In the event of a total absence of availability on a snow-covered destination, we guarantee the reimbursement of the amount of your stay (excluding booking fees, in MMV vouchers), upon request by mail to Mer Montagne Vacances, Service Garantie Meilleure Neige, 51 av. France d'Outremer BP 39, 06701 SAINT LAURENT DU VAR CEDEX", accompanied by screen shots corresponding to the opening information of the slopes during the 4 consecutive days in question. Excluded: the first week of the establishment's opening until Christmas week.
XIII. OPTIONAL INSURANCE - HORIZON PACK
mmv has taken out a civil liability insurance policy that is suitable for hotels. However, customers are advised to take out personal insurance to cover such liability. In the event of loss or theft of personal effects or damage caused to third parties within its holiday establishments, mmv shall not be liable beyond the scope of the relevant statutory provisions.
For your safety, mmv has negotiated the Pack Horizon multi-risk contract. This includes the following guarantees: a stay cancellation guarantee covering ALL JUSTIFIED CAUSES (excess of €40); a stay interruption guarantee (including any on-site services not used) based on a pro rata calculation of the time remaining; an assistance guarantee (including medical repatriation in the event of illness or serious accident, repatriation of remains in the event of death, medical costs and hospital care on site, and search and rescue costs in the case of mountain stays). The general terms of the policy will be sent to you when your subscription is confirmed (also available here). You can take up this option when making your booking. The insurance guarantees are valid before, during and after your stay, but do not apply to the outward/return journeys or road accidents. Policies are taken out on an individual basis.

THE RATES :
The HORIZON PACK rates apply to all participants registered on the booking form. These rates fluctuate according to the rate level in which the amount of the reservation is located. In the event that services are added after the reservation, the price of the HORIZON PACK will be modified, if necessary, according to the new total amount of the stay. WHAT TO DO IF YOU MUST CANCEL YOUR STAY.
You or a member of your family must inform mmv of the cancellation by post as soon as the event preventing your departure (and which is covered by the policy) occurs. Having informed mmv of the cancellation, you have 5 working days in which to inform the insurance company.

NEED FOR ASSISTANCE DURING YOUR STAY
To benefit from the guarantees of the Horizon Package contract (personal assistance, medical expenses, replacement driver, search & rescue expenses, death assistance, legal assistance), you must contact or have a third party contact the insurance company, available 7/7 days and 24/24 hours, as soon as your situation suggests that you may incur expenses falling within the scope of the horizon pack guarantee.

YOU HAVE INTERRUPTED YOUR STAY
Following the occurrence of an event covered by the Horizon Pack contract, you are reimbursed for unused days of activity or stay.
ATTENTION: services that have not been previously agreed by the insurance company or that have not been organised by the insurance company will not give rise to any reimbursement or compensatory indemnity.
It is hereby pointed out that activities associated with the organisation and sale of travel or stays for specific dates or periods are not subject to the 7-day cooling-off period that applies to distance selling.
XIV. FINANCIAL SECURITY
MMV has taken out insolvency protection with the APST, 15 Avenue Carnot 75017

XV. PERSONAL DATA
In accordance with Regulation (EU) 2016/679 of 27 April 2016, known as the DGPS, MMV undertakes to process only the customer's data strictly necessary for the performance of its services. It undertakes to keep the data processed only for the period strictly necessary for the performance of its task and for proof that its services have been properly performed, subject to legal obligations. For the purpose of entertainment within the Hotel Club or Residence Club and to create and share souvenirs, each client during his stay authorizes MMV, any person or company authorized by it to be photographed and filmed as well as his minor children for free. This content may be used on any paper, audiovisual, multimedia, computer (Internet and social networks) media for informative, advertising, promotional and commercial purposes to promote MMV establishments and companies and its activities. Each participant thus waives any claim or legal action relating to this authorization. This authorization is valid for a period of 5 years from the acceptance of these terms and conditions of sale at the time of booking.
Any customer who does not wish to be photographed or filmed under these conditions during the stay may inform MMV in writing when making the reservation or with the management or host at the place of stay.
